17.1 General
A) If carrier is unable to provide the container type/size required by shippers at time of booking due to lack of available empty equipment or to other unavoidable operational constraints, carrier has the option to substitute other type/sizes of container for per container rated shipments.
B) The following clause must be put on all Bills of Lading covering shipments freight under this rule:-
"EQUIPMENT SUBSTITUTION PERFORMED"
[Indicate the size of equipment requested by shipper and the size of equipment provided by carrier under this Rule]
C) Equipment substitution cannot be applied if there is no measuring certificate issued by official measurers. In the absence of such certificate, the ocean freight shall be assessed based on the equipment utilized.
D) Equipment Free time, Demurrage and Detention Charges will be assessed per the actual equipment type.
E) Substitution of equipment will not affect the responsibilities and liabilities to Shipper or Consignee.
