19.1 Carrier Terminal Rules and Charges at Origin
A. Except as otherwise provided, all cargo shall be subject to origin receiving charges as specified in the following rules.
B. For each Bill of Lading, each commodity tariff item shall be subject to a minimum of one revenue ton. In the event that both Hazardous (HAZ) and Non-Hazardous (NHZ) cargo are shipped under the same commodity tariff item, each cargo type will be subject to a minimum of one revenue ton.
C. The receiving charge applies in addition to the minimum Bill of Lading charge.
D. Except as otherwise provided, the following is included in the origin receiving charge after the cargo has been received by the carrier at his terminal or vessel berth:
a. Loading the cargo onto the vessel;
b. Wharfage assessed by the port or applicable terminal tariffs.
E. Except as otherwise provided, the following is not included in the origin receiving charge:
a. Any charges prior to cargo receipt by carrier;
b. Any unloading charge from the shipper's or his agent's delivering carrier including but not limited to:
i. Rail equipment unloading charges for unpacking cargo from rail cars or rail trailer equipment;
ii. Charges for unloading cargo from an inland carrier's equipment.
F. The origin receiving charge on CFS cargo includes the following services:
a. Issuing truck receipt for cargo;
b. Tallying cargo;
c. Ordinary sorting and stacking of cargo;
d. Loading cargo into carrier's container;
e. Transport of container from CFS to CY;
f. Wharfage as assessed by port authorities or applicable terminal tariffs;
g. Railcar unloading of refrigerated commodities.
h. Exception: The transloading of refrigerated cargo to a refrigerated control dock is not included in the service for CFS cargo. If the Shipper requires such service, then it will be for the account of the cargo.
G. Payment
The origin receiving charge shall be prepaid, except where freight monies are billed collect, the origin receiving charge may be billed collect and collected in U.S. dollars or its equivalent in local currency at carrier's option.
19.2 Carrier Terminal Rules and Charges at Destination
A. Definitions:
Delivery is defined as the service performed to more cargo from ship's tackle to place of rest on the Terminal. On cargo delivered breakbulk ex vessel, delivery is accomplished by making the cargo available at first place of rest beyond ship's tackle. On cargo delivered breakbulk ex container, delivery is accomplished by making the cargo available at carrier's Container Freight Station.
On cargo delivered in containers, delivery is accomplished by making the container available at carrier's Container Yard. Except as otherwise provided, wharfage is included in the Delivery Charge.
B. Service Included in the Delivery Charge:
1. For Breakbulk cargo ex vessel, delivery from ship's tackle to place where loaded into railroad cars or other vehicles, on the Terminal.
2. For breakbulk cargo ex vessel, delivery from ship's tackle to place of rest on terminal, barge or lighter, including ordinary sorting and/or pilling and trucking.
3. For breakbulk cargo ex container, movement of container to carrier's Container Freight Station, unloading of cargo from carrier's container at the CFS, ordinary sorting and/or pilling, and making available at CFS or pickup or loading to railroad cars or other vehicles. Loading to railraod cars or other vehicles is not included in the Delivery Charge.
4. For cargo delivered intact in carrier's containers, delivery of container from ship's tackle to a point in the Container Yard where accessible to consignee's drayman, under the provisions of Rule ‘Use of Carrier Equipment’ of this Tariff.
5. Wharfage as assessed by Port Authorities or applicable terminal tariffs.
C. Except as otherwise specifically provided herein, charges must be shown on the Bill of Lading and collected prior to release of cargo.
D. Except as otherwise provided herein, destination delivery charges may be shown on the bill of lading and may be prepaid by the shipper or collected either in U.S. Dollars or its equivalent in local currency from the consignee at the carrier's option in accordance with the provisions for ‘Payment of Freight’ in this tariff.
E. Any additional Charges imposed by the local port or terminal operators per their local tariffs will be for account of cargo, and that carriers can at their option show these charges on the Bill of Lading.
