20

Free Time and Detention

20.1 General

For the purposes of this rule, counting of free time and detention charge are classified under two categories, namely refrigerated containers (including both active and non-active refrigerated containers) and non-refrigerated containers (including bulk, tank, open top, hard top, ventilated, flat rack, platform, general purpose and all other non-refrigerated containers.)

Carrier may dispatch empty container(s) directly from an inbound consignee’s location for outbound shipments for the same entity.

a) In such instance the detention rules of tariff OOLL-053 (Equipment Interchange Agreement Tariff) shall apply if this takes place in USA.

b) In Hong Kong and Guangdong Province PRC, the container may be dispatched to an unaffiliated shipper, in which case any detention charges will be for account of the outbound shipper.

 

Extension of Free Time

In the event shipper/consignee incurs and has paid destination charges where cargo has been shut out due to conditions beyond shipper/consignee control or the vessel, shipper/consignee may petition Carrier for an extension of free time and a refund of detention charges attributable to the period during which the cargo was shut out. Shipper/Consignee shall submit to Carrier within 30 days of payment of charges a sworn statement describing the circumstances in detail, accompanied supporting documentation.

An extension of free time and a refund of the detention charges shall be granted if (i) Carrier determines, based on the documentation provided by shipper/consignee, that the shut out of the cargo was caused by circumstances beyond shipper's control or the delay or cancellation of a vessel and (ii) the cargo was tendered to Carrier for loading on the first vessel call after the expiration of free time as extended by the period of the shut out. If one or both of the foregoing conditions is not satisfied, shipper/consignee shall not be entitled to any extension of free time or refund of detention charges.

In the event shipper/consignee meets the requirements in the preceding paragraph, shipper/consignee's free time shall be extended by a period equal to the number of days during which the cargo was shut out due to circumstances beyond the shipper/consignee's control or the delay or cancellation of the vessel.
