Definitions

ALL-IN/All Inclusive: (TPT EB only)
Unless otherwise specified under a particular tariff rule or rate item, the term "all-in" or “all inclusive” is defined as including the CY or CFS Destination Delivery Charge, Bunker Charge and/or Currency Adjustment Factor if applicable.

BOXCAR:
Means rail boxcar as defined in the Official Railway Equipment Register.

BULK CARGO:
Means an aggregate of material without shape or outline and capable of flowing or fluctuating, not subject to piece count.

CARGO, N.O.S.:
Means articles not otherwise specified in individual commodity items of the rates tariffs.

CARRIER:
Means participating Water (Ocean) and/or Inland Carriers.

CHASSIS:
Means a wheeled assembly, with or without chassis, constructed to accept mounting of a demountable trailer body, container or flexi-van.

COFC:
Means container on flat car rail service in which container without chassis, bogies, or wheels are loaded on rail cars.

COFC RAIL CARRIER'S TERMINALS:
Means Rail carriers' terminal at which both COFC and TOFC containers can be handled.

CONSIGNEE:
Means the person, firm or corporation shown on the Bill of Lading as the receiver of the property transported by the carrier.

CONSIGNOR:
Means the person, firm or corporation shown on the Bill of Lading as the shipper of the property received by the carrier for transportation.

CONTAINER:
The term "container" means a single 20-foot, 40-foot, 45-foot or 48-foot water (ocean) carrier's container and/or a participating rail/motor carrier's container, as described in the Official Chassis Equipment Register or the International Registry of Trailer and Trailer Containers and Chassis Equipment, and shall include ventilated, insulated, reefer, flatrack, vehicle rack, portable liquid rack, or open top container. Except as otherwise provided, the term "trailer" is interchangeable with "container" and shall have the same meaning.

 

CY AND CFS CARGO
1. CY Cargo is that cargo loaded into or unloaded from transport equipment by a shipper or consignee outside of carrier's terminal facility.
2. CFS Cargo is that cargo tendered to or received from a carrier at his terminal and loaded into or unloaded from transport equipment by the carrier.

 

CONTAINER FREIGHT STATION (CFS):
The term "Container Freight Station" (CFS) means the location designed by the Carrier or his authorized agent for the receiving of goods to be stuffed into containers or for the delivery of goods stripped from containers by the Carrier or his authorized agent.

CONTAINER YARD (CY):
The term "Container Yard" (CY) means the specific location designated by the Carrier where (1) the Carrier assembles, holds or stores containers, and (2) where containers loaded with goods are received or delivered. The locations of each Carrier's CYs must be on file with the Agreement Managing Director. Any change in a Carrier's registered CY can be made effective upon filing with the Agreement. Carriers are not required to file the locations of their PRC CFS/CY with Managing Director, with the exception of Shenzhen, for which, the CFS/CY locations must be filed.

CONTAINER DEPOT (CD):
The term "Container Depot" means a place for receiving or pick up, and storage of empty containers and chassis. Such equipment may be released to shippers at not greater cost than equipment released to shippers from designated CYs.
No loaded containers may be received at Container Depots and such locations may not be owned or controlled by a shipper or his agent.

CONTAINER SERVICES:
The term "Container Services" means the services performed by the Carrier or loading port in receiving and stuffing cargo into containers at CFS and transporting such containers from CFS to CY.

CFS RECEIVING SERVICES:
The term "CFS Receiving Services" means the services performed at loading port in receiving and packing cargo into containers at CFS and transporting such containers from CFS to CY or shipside. "CFS Receiving Services" referred herein are restricted to the following:

1) Moving empty containers from CY to CFS
2) Drayage of loaded containers from CFS to CY and/or Ship's tackle
3) Tallying
4) Issuing dock receipt/shipping order
5) Physical movement of cargo into, out of and within CFS
6) Stuffing, sealing and marking, containers
7) Storage - (Not applicable to Taiwan)
8) Ordinary sorting and stacking
9) Preparing carrier's internal container load plan

Nothing above is to be construed to prohibit carriers at shippers request from stowing cargo in containers in such a manner as to attempt to facilitate CY delivery at designations of all or part of the cargo therein nor to preclude carrier from supplying cargo interest relevant information re the cargo stowed in each container.

For both CY and CFS origin cargo, the cost for providing Tarpaulins and lashing gear for Flat Rack and Platform Top
containers shall be for account for cargo.

CTR:
Container.

DAY:
Means a twenty-four (24) hour period beginning at 12:01 A.M.

DELIVERY ORDER:
Means a document issued by the Carrier or its agent authorizing the terminal operator to release all or a portion of a shipment to a Consignee or its agent. More than one Delivery Order may be issued on a single shipment and/or Bill of Lading.

DEMURRAGE:

Demurrage Charges are those costs which are incurred when a container with cargo, or cargo devanned from a container,
is held at carrier's discharge port CY or CFS, or destination point CY or CFS, or at a carrier's Destination Interchange Terminal (DIT), beyond the permitted free time as stipulated in the applicable rule in this tariff.

DETENTION:
Detention Charges are those costs incurred when a shipper/consignee or his agent removes a container from carriers origin/destination CY to the shipper/consignee's place of business, and does not return the loaded/empty container to the CY, or to another location designated by the carrier, within the permitted free time as stipulated in the applicable Rule in this tariff.

DESTINATION INTERCHANGE TERMINAL (DIT):
The Destination Interchange Terminal (DIT) is defined as the facility operated by the ocean carrier, or his agent, at which containers are interchanged with the delivering Motor Carrier.

DESTINATION RAIL/MOTOR FREIGHT STATION (DRFS/DMFS):
The facility maintained by the destination rail or motor carrier, or its agent, at which the service of unstuffing of containers is available along with the sorting of less than container load shipments and making such shipments available to consignees.

For the purpose of this tariff, when reference is made to the Destination Rail Freight Station (DRFS), it will be understood that the Destination Rail Freight Station also refers to and includes the Destination Motor Freight Station (DMFS) and Destination Container Freight Station (DCFS).

DESTINATION RAIL YARD (DRY)/DESTINATION MOTOR YARD (DMY):
The term Destination Rail Yard (DRY)/Destination Motor Yard (DMY) means:
(a) For the purpose of this tariff, when reference is made to the Destination Rail Yard (DRY), it will be understood that the Destination Rail Yard (DRY) also refers to and includes the Destination Motor Yard (DMY) and Destination Container Yard (DCY).
(b) The place where stuffed containers are delivered by Rail/Motor Carrier and where empty containers will be returned by consignees.
(c) The place where Rail/Motor Carrier assembles, holds or stores Ocean Carrier's containers.

DISCHARGE PORTS:
Means any port of call at which a vessel of water carrier party to this tariff discharges cargo or makes cargo available for delivery at the CY/CFS, or discharges cargo for interchange with an Inland Carrier.

DIVERSION:
Means a change in consignee, destination or route.

DMT:
Destination Motor Terminal.

DRT:
Destination Rail Terminal.

DRY CONTAINER/CARGO/BOX:
Means cargo other than that requiring temperature control.

EFFECTIVE DATE:
Means starting from 12:01 AM on the effective date.

ESCORT FEE:
It is a fee assessed by the Philippine Export Processing Zone Authority to cover for the labor cost of its personnel in escorting the stuffed and sealed containers from the Mariveles Export Processing Zone to the port of Manila.

EX:
Means from.

EXPIRY DATE:
Means up to 12:00 AM on the expiry date.

EXPLOSIVE CARGO:
Means cargo falling within Class A, B and C explosives as defined in Bureau of Explosives Tariff and other applicable
publications.

HOLIDAYS:
Means all National Holidays per calendar declared by respective local customs and/or port authority.

IPI:
Means interior point intermodal via U.S. West Coast.

KNOCK DOWN:
Knock Down (K/D) means that an article must be taken apart or telescoped in such a manner as to reduce its bulk from
its normal shipping cubage when set up or assembled.

LABEL CARGO:
Means cargo requiring White, Yellow, Red, Red Gas, Green Gas, Poison, Poison Gas and Tera Gas labels as shown in
Bureau of Explosives Tariff and/or under IMO Classification.

MIXED SHIPMENT:
Means a shipment consisting of articles described in and rated under two or more rate items of this tariff.

LOADING PORT:
Means an origin port regularly served by any OOCL from which tariff rates generally apply and which is used as the basing point for application of non loading charges.

LUMP SUM (LS) RATE:
Means freight rate for a quantity of cargo. The rate is subject to all accessorial charges unless otherwise specified.

MOTOR CARRIER:
Means inland motor carriers or motor or motor carriers as named in this Tariff.

MOTOR SERVICE:
Means the movement of cargo via a motor carrier to an interchange port with an ocean carrier. Motor service within a commercial zone (CZ) to or from a rail ramp or to a pier is not "motor service" within the meaning of this definition.

MOTOR-RAIL SERVICE:
Means the movement of cargo by "motor service" to a rail terminal and then "rail service" to the interchange port.

NON-HAZARDOUS CARGO:
Non Hazardous means non-label cargo which is permitted stowage between decks or under deck (other than Magazine)
under CFR title 46, Shipping, as amended from time to time, and as set forth in above, and rule covering Governing
Publications, and such cargo will be rated in accordance with the rates applicable therefore as provided in the tariff item.

ONE COMMODITY:
Means any or all of the articles described in any one rate item in this tariff.

ORDINARY CARGO:
Means cargo not requiring hazardous label (See Rule 16), the use of a tank container or deep tanks, or atmosphere or temperature control, and which is suitable for carrier in a dry freight container.

OUTPORT:
Means an origin or destination port, other than a Base Port, to which rates apply but which may be subject to Outport Arbitraries.

PREPARED:
In connection to foods, means further processed other than cut-up or frozen. Such further processing includes but is not limited to breaded, cooked, marinated, salted, smoked, dried, pickled etc.

RAIL CARRIER:
Means inland rail carrier or rail carriers as named in this tariff.

RAIL SERVICE:
Means the movement of cargo via a rail carrier from a point of origin to an interchange port with an ocean carrier.

RAILCAR:
Means rail boxcar, flatcar, gondola car, hopper car or refrigerated boxcar.

RATE:
Means the tariff rate including terms and conditions filed in ATFI providing a specified level of transporation service for a stated cargo quantity, from origin to destination, on or after a stated effective date or within a defined time frame.

RATE BASIS:
Means the method used for filing a tariff rate. A rate basis may be expressed as Weight (W), Measure (M), Weight or Measure (W/M); Per Container (PC), Each(EA), Ad Valorem (%), etc. for determining the quantity of freight tendered and may include a minimum weight or quantity requirement.

REEFER:
Means refrigerated.

REEFER CONTAINER/CARGO/BOX
Cargo moved in an active temperature controlled container.

REVENUE TON:
Means 1,000 kilos or 1 cubic metre as freight charges are assessed.

REVERSE IPI (RIPI):
Interior Point Intermodal via U.S. East Coast.

SHIPMENT:
Except as otherwise provided in specific rules or rates in this Tariff, means a quantity of goods, tendered by one consignor on one Bill of Lading at one port of origin at one time in one or more containers for one consignee at one point of destination.

SHIPPER:
Means
(A) a cargo owner;
(B) the person for whose account the ocean transportation is provided;
(C) the person to whom delivery is to be made
(D) a shippers association; or
(E) an ocean transportation intermediary, as defined in the U.S. Shipping Act, that accepts responsibility for payment of all charges applicable under the tariff or service contract.

STUFFING, UNSTUFFING:
Means the physical placing of cargo into or the physical removal of cargo from carrier's containers.

TRAILER:
Means a flatbed truck or trailers. The term trailer may be used interchangeably with the term container.

TOFC:
Means trailer on flat car rail service in which container on chassis, bogies, or wheels, are loaded to rail cars.

TOFC RAIL TERMINAL:
Means origin rail carrier's terminals at which only TOFC containers can be handled.

USD:
U.S. Dollars.

WATER CARRIER/OCEAN CARRIER:
Means participating Water (Ocean) Carrier.

WATER CARRIER'S TERMINAL:
Means the CFS and CY at Origins shown in Rule No. 1 where Water Carrier assembles, holds or stores its containers.
