Circular on Import of Metal Scrap for Indian Ports

Pls find attached circulars issued from DGFT, as per these circulars, shipper (based out side India) and consignee(base in India) for import of Metal scrap, both must be registered with DGFT in appendix 5 and 5b else they will not allow to import metal scrap in India and customs may cease the cargo/containers

Initially DGFT had given deadline of 31st May,2006, now this system will start effect from 1st November,2006 and any, in cases where Bill of Lading is dated 1st November, 2006 or before, imports will be allowed on the basis of Pre-Shipment Inspection regime in terms of Para 2.32 of the Handbook of Procedures (Vol.1). Till the new system of import from registered sources comes into effect

Request all POL’s to have compliance with the said requirements before loading Metal Scrap for Indian Ports to avoid any disputes in future

POL also needs to send PRE – INSPECTION CERTIFICATE to Indian Ports prior discharge of Scrap containers into Indian Ports, else same cannot be discharged & may retain on board the vessel.

PUBLIC NOTICE No. 30 (RE-2006)/2004-2009

NEW DELHI : DATED : 07/07/2006

In exercise of the powers conferred under Paragraph 2.4 of the Foreign Trade Policy, 2004-09 and Paragraph 1.1 of Handbook of Procedures (Vol.1), the Director General of Foreign Trade hereby makes the following amendments in the Handbook of Procedures (Vol.1).

1. Last Para of Paragraph 2.32.2 (g) will be amended to read as follows :

“The new system of import from registered sources will come into effect from 1st April, 2006. However, in cases where Bill of Lading is dated 1st November, 2006 or before, imports will be allowed on the basis of Pre-Shipment Inspection regime in terms of Para 2.32 of the Handbook of Procedures (Vol.1), notified vide Public Notice No. 1 dated 8th April, 2005 and as amended from time to time, till the new system of import from registered sources comes into effect.”

REGISTRATION OF OVERSEAS SUPPLIERS FOR THE SUPPLY OF METALLIC WASTE AND SCRAP UNDER APPX 5B

Those applicants who have applied for registration under Appx 5 B of Handbook of Procedure( Vol I) of Foreign Trade Policy on or before 31st May 2006 may submit the following documents also on or before 14th July 2006 to Import Licensing Section, O/o Directorate General of Foreign Trade, Department of Commerce, H-Wing, Udyog Bhavan, New Delhi-110011, if not submitted earlier.

1. Mandatory Documentation Requirements

(i) Membership certificate with Trade associations like BIR/ISRI/EUROFER or any other Trade Association recognized by the Government of that Country.

Or

(ii) ISO accreditation.

Or

(iii) Accreditation by Chamber of Commerce of that Country.

Or

(iv) Accreditation by Environmental Agency of that Country.

These documents would be related to business of handling of metallic waste & scrap.

2. Audited balance sheet of the company by a registered CA along with letter of incorporation.

3. Information regarding export of metallic waste and scrap to any other country.

4. Legal undertaking stating that they will abide by Law of land and Provisions of Para 2.32 of HBP Vol I.

5. If the applicant is registered with AQSIQ, the applicant may submit a copy of this registration as well.

Note: If the certificate(s)/ document (s) is/ are not in English, then translated certified copy in English may also be enclosed.
