China’s 24 Hour Advanced Manifest Regulation – USA and Canada Origin Cargo for Direct China Port Discharge
Further to our previous advisories on oocl.com (http://www.oocl.com/eng/resourcecenter/customeradvisories/china24hradvancemanifestrule/2008.htm ), we would like to provide the following update on the subject matter implementation progress.
From January 2009, OOCL started to implement the new automated China customs manifest submission process on a phased service by service basis. This phased implementation was completed in May. OOCL is already fully compliant with China customs manifest submission to the relevant China customs designated authorities.
According to the most recent information available, our understanding is that with effect from July 1st, 2009, a parallel electronic and hard copy run period of the new customs submission process will be enforced by China Customs. This means that the full customs manifest must be submitted electronically by ocean carriers as of July 1st.
A penalty may be imposed at China Custom's discretion for any failure to submit the manifest timely due to late submission of Shipping Instructions. As of July 1st, although OOCL will not be implementing a do not load compliance requirement, any such penalty if received will be the responsibility of the USA and or Canada origin cargo shipper if related to late, incomplete or erroneous Shipping Instruction information.
In order to meet the new China Customs rule requirements, and to ensure smooth shipment handling after the implementation of the China 24 requirement, we appreciate your kind cooperation to provide OOCL your shipping instructions, with container and seal information, at least 2 working days prior to the load port cargo cutoff. This will allow for the required documentation preparation and manifest information submission to China Customs.

We appreciate your assistance and cooperation in complying with these new requirements and adjusting your shipping instruction submissions on an as-needed basis to meet the timing guidelines required by China Customs.
All amendments after the initial Shipping Instruction submission must be received in writing.
OOCL will continually review the implementation progress with China Customs to ensure minimum impact to our customers’ shipments in the parallel run period.
Please also bear in mind that the US CBP and Bureau of the Census Mandatory AES information submission deadline of February 1, 2009 has not changed. For vessels with a US load port please note that OOCL now employs a "No AES information; No load policy" if the required AES information is not submitted in accordance with the previously communicated service loop load port deadline.
